Sprott, Golden & Bardwell Welcomes Kirby D. McDonald as Associate Attorney in Fayetteville and Harrison Offices

Kirby McDonald was born and raised in Boone County. He is a proud graduate of Valley Springs. Kirby attended the University of Arkansas for his undergraduate, obtaining a Bachelor of Arts degree with an emphasis in Political Science. Upon completion of his undergraduate, Kirby enrolled in the University of Arkansas School of Law.
While in law school, Kirby clerked for Jeff Slaton, P.A., and gained insightful knowledge running a general practice law office, with an emphasis on a client driven practice. Additionally, Kirby participated in several legal clinics, in which he was a special rule 1.5 certified attorney, during his time at the University of Arkansas School of Law. He participated in the Civil Clinic where he represented low income clients in wage theft matters, the Criminal Defense Clinic, where he gained experience representing underserved clients charged with misdemeanors, and he also worked in the Wills Clinic, where he paired up with habitat for humanity to assist in drafting estate documents for single mothers.
Upon completing law school, Kirby passed the bar, and began working for a law firm in Little Rock. While in Little Rock, Kirby’s legal focus was Social Security Disability, where he represented and fought for clients to be awarded the disability benefits, they earned during their working career. Kirby also represented wrongfully injured clients, whether they were injured in a car wreck, slip and fall, dog bite, or any other form of negligent injury, Kirby was in their corner to make sure they were given the time they needed to heal, and a fair out come once their claim wrapped up.
After three years of living and working in Little Rock, Kirby came back home. He joined the winning team of Sprott, Golden and Bardwell in October of 2019. He will be working out of their Fayetteville office, but will be serving clients all over North Arkansas.
When Kirby isn’t at work, you can find him enjoying the wonderful bounty of the Ozarks. Whether it be hunting and fishing with his family, canoeing with his wonderful wife, or hiking with his trusty companion Gunther (the dog), he takes every chance he can get to spend time in the marvelous outdoors we are blessed with here in the Ozarks.

Keep It Private! Sealing Your Criminal Record

In 2014, the state of Arkansas enacted new laws clarifying the process by which a person may seal his or her criminal record. By simply filing a petition, any eligible person may request the court to treat his or her criminal record as confidential. Once the court grants the request, the person’s criminal history is deemed to have never happened, and the person may lawfully state to potential employers, family members, and friends as such.

A person’s criminal record may be sealed whether it stems from a misdemeanor or a felony. An example of a misdemeanor that may be sealed is the violation of public intoxication. A person convicted of this violation may petition the court to bury this record of criminal history just sixty (60) days after all time is served and all fines and court costs are paid in full.

An example of a felony conviction that a person may request to be sealed is the violation of receiving stolen property. The law is a bit more stringent for sealing a felony criminal history record, but the process of requesting is essentially the same. A particular difference worth noting is that the person may not make the request until five (5) years have elapsed since completing the sentence.

The statutes require that the petition contain specific language, that it be served on the prosecutor, and specifies various time limits including when a prosecutor can object and a hearing may be scheduled. Most importantly, though, the statutes set out the burden of proof the prosecution must present if your petition is contested.

Power of Attorney

Has a loved one ever tried to help you with a banking chore, a utility outage, or just an inquiry about a bill, but was told she could not get information or take any action because the account is not in her name? A power of attorney is the answer. A power of attorney is a writing in which one person gives another person the power to act on his or her behalf. It can be a simple and narrow power, for example, where John Smith signs a document saying, “Dear XYZ Cable Company: I authorize Jane Smith to get information about my account and give you orders.” Or, it can be a broad, general power in which John Smith appoints Jane Smith as his agent to act in connection with all John Smith’s business affairs.

In the above example, once the power of attorney is presented to XYZ Cable Company, the company is then free to deal with Jane regarding John’s account. Such a document is very useful particularly if John is ill, has a disability or is unavailable to manage the account as needed. The company can still deal directly with John, but now also is free to deal with Jane if she calls them.

When a client contacts us about a will or trust, we usually make a general durable power of attorney part of the package. Powers of attorney cover business affairs and can also cover health care matters.

With a “general” power of attorney, Jane can do most things for John that he could do if he were acting for himself. With a “durable” power of attorney, Jane’s power to act continues indefinitely unless it is revoked by John. So by giving Jane his power of attorney, John can make sure things get done for him. Between spouses, or between other trusted persons, the general durable power of attorney for business and the health care power of attorney are essential parts of the estate plan.

Joseph C. Hoke joined the firm in July 2018 as an associate attorney. He earned a Bachelor’s degree in History from Hendrix College in Conway, Arkansas in 2011, and a Juris Doctor from William H. Bowen School of Law at the University of Arkansas, Little Rock, in 2017. Joseph handles matters in divorce/custody/family law and criminal defense. Before joining the firm, he worked as a solo practitioner in Conway, Arkansas and as Parent Counsel Attorney for Pope and Johnson counties with the State of Arkansas. Joseph previously lived in Little Rock, Arkansas and is looking forward to his calling Harrison home.
